MySpace.co.uk Gets Lucky: Domain Returned To Original Owner

Posted on | April 29, 2008 | 2 Comments

An independent appeals panel has overturned a heavily-criticised decision to hand control of the myspace.co.uk domain to Rupert Murdoch’s Fox Interactive Media.

Absolutely stunning. I can’t believe it… since there was a problem with the .co.uk showing Myspace related ads. The co.uk was registered before the .com; but like I said, there were issues with the parked page starting to show advertisements related to Myspace.

Nominet’s Dispute Resolution Service (DRS), had ruled in favour of MySpace in January, despite the domain having been registered by a small British ISP six years before the US social network was founded.

    This is good news.

Yes, the parking service showed MySpace related ads but that alone shouldn’t be grounds for losing the registration, that’s grounds for a warning.

Also, if I remember correctly, it was being actively used as an email host. So tell them to get on with their business and stay away from optimized advertising. There was clearly no bad faith *on registration* so give them a chance to change the landing page to a non-infringing use.

Let’s see how LH.com pans out. That’s the one I’ve got my eye on!
